Legal and medical procedures included in the gestational surrogacy in the US process
Medtravelco ensures that all necessary legal, psychological, and medical evaluations are conducted to guarantee a secure process. We notify all professionals involved, including criminal background checks and psychological assessments for both the surrogate and intended parents. A medical examination follows, where the surrogate undergoes tests for drug use, infectious diseases, and general reproductive health. If the surrogate is in a relationship, her partner must also undergo specific screenings.
Once the surrogate is medically approved, legal contracts are drafted and reviewed. Both parties consult their respective lawyers before signing. Notarization of documents can be done in Spain for added convenience. Within seven days of signing, intended parents deposit an initial amount of $50,000 into a trust account to cover the surrogate’s compensation and other related costs. The first compensation payment is made after the legal agreement is finalized.
The fertility treatment process lasts approximately four to six weeks. Medications for the surrogate and egg donor (if applicable) are paid directly by the intended parents. The embryo transfer is followed by pregnancy tests to confirm implantation. A subsequent ultrasound determines the number of successfully implanted embryos. Once the pregnancy is confirmed, the surrogate begins prenatal care with her chosen OB/GYN.
Final Stages and Birth Preparation
Throughout the pregnancy, intended parents can request a 4D ultrasound between weeks 26 and 34 to see their baby in real-time. Around week 24, legal proceedings begin for parental establishment, ensuring that the intended parents’ names appear on the birth certificate. Between weeks 25 and 30, a final financial estimate is prepared, detailing remaining costs and ensuring sufficient funds are available.
Intended parents are encouraged to travel to the US by week 36–37 for a single baby or week 33–34 for twins to be present at birth. They may be in the delivery room if the surrogate agrees. In the case of a C-section, typically only one person is allowed in the operating room, subject to the surrogate’s preference.
Post-birth, Medtravelco and our US partner agency assist with obtaining the baby’s birth certificate, passport, and social security card. If required, a representative can accompany parents to appointments, ensuring a seamless transition as they prepare to return home with their new family member.
